Terms of Service

Effective date: 22 October 2026

Draft awaiting review by a lawyer. The text below has not been checked by a legal professional yet, so its wording may still change before it enters into force.

This document ("Terms") sets the rules for using Kadraris Studio, Kadraris API and the kadraris.com website (jointly the "Service"). You accept the Terms when you open an account or start using the Service. Users of the Polish edition at kadraris.com/pl (the short address kadraris.pl leads there) are bound by the Polish Regulamin, not by this document.

1. Who we are

The Service is run by Piotr Olszewski, ul. Białołęcka 247, 03-253, Warszawa, NIP (Polish tax ID) 5242572263, referred to here as "Kadraris", "we" or "us". Our e-mail address is promptowy@gmail.com. Under the EU Digital Services Act, the same address serves as the single contact point for both users and public authorities. You can write to us in English or Polish.

2. Definitions

  • Account - the user account you hold in the Service.
  • Balance - money you have paid in advance and that sits on your Account in US dollars; Generations are paid from it.
  • Top-up - any payment that increases your Balance.
  • Generation (also Task) - one request sent to an AI model via Studio or the API, such as a picture, a video clip, an audio file or a chat completion.
  • Input - everything you send to the Service, including prompts, parameters, images, sound, files and URLs.
  • Output - what a model produces in response to your Input.
  • API Key - a secret string beginning with sk-kd- that identifies API calls made on your Account.
  • Consumer - an individual who uses the Service for purposes unrelated to their trade, business or profession.

3. The Service

3.1. With a single Account and a single Balance, the Service lets you use AI models built by other companies to create images, video, audio and music, and to work with chat and code models. Those models run on infrastructure operated by third parties. Generation requests travel to the model vendors through external AI model infrastructure providers used by the Service.

3.2. We publish the model list, model parameters and prices at /models and via GET /v1/models. Models may be added, modified or withdrawn, for instance when their developer retires them or changes its conditions. Before withdrawing a model that people actively use, we will make reasonable efforts to warn you in advance, but the continued availability of any given model is not guaranteed.

3.3. Output is produced automatically. It can be wrong, incomplete or surprising, and it can resemble Output created for someone else. Check it before you rely on it or make it public.

3.4. We make no commitment as to availability levels, response times or hours of support. Requests for some models may be sent to more than one infrastructure provider to soften the effect of outages; this does not mean the Service will never be interrupted.

3.5. You need an e-mail address and either an up-to-date browser with JavaScript turned on (for Studio) or any HTTP client capable of HTTPS requests (for the API).

4. Your Account

4.1. You may open an Account only if you are 18 or older and legally capable of concluding a binding contract. When you open an Account for a company or another organization, you state that you have the authority to bind it to the Terms.

4.2. The details you give us must be true and kept current, billing details in particular. Keeping your login credentials secret is your responsibility, and so is everything that happens on your Account.

4.3. Holding several Accounts as one person or organization is allowed only for a legitimate purpose, for example keeping projects apart. You may not open Accounts to exploit the referral program, escape a suspension or evade rate limits.

4.4. The Service is not available to you if sanctions forbid us to provide it to you, or if you are in a country where providing it would breach export control or sanctions rules.

5. Balance, prices and payments

5.1. You pay in advance. There is no subscription and you commit to no minimum spend. Accounts on kadraris.com are settled in US dollars.

5.2. A Top-up must be at least $10. Ready packages are $10, $25, $50 and $100. Your Balance grows by exactly the amount you pay.

5.3. On kadraris.com prices are given in US dollars without taxes, and the amount you pay is the amount credited to your Balance. If you need a Polish VAT invoice, or reverse charge as an EU business with a valid VAT number, use the Polish edition at kadraris.com/pl, where billing is in Polish zloty.

5.4. Stripe, our payment provider, handles payments. Your full card number never reaches us and we do not store it. Your Balance is credited once the payment provider confirms the payment. Each Top-up comes with an invoice or receipt, available in your Account.

5.5. The Balance has no expiry date, and there are no fees for inactivity.

5.6. Each model is priced per unit, and the unit is published: one image, one second of video, one track or one second of audio, or one million input and output tokens. The Service shows you the expected cost of a Generation before it starts (in the API: estimated_cost). Starting the Generation places a hold for that amount on your Balance. On completion we charge the real cost and free whatever part of the hold was not used. Chat models are charged by the tokens actually processed.

5.7. A Generation that ends with the status failed costs you nothing, whatever the reason (a provider error, a timeout or the model refusing your Input), and the whole hold is released. A Generation that completes successfully is charged, even if you do not like the Output.

5.8. When your Balance is too low to cover the estimated cost, the request is refused with HTTP 402 and the Generation never starts.

5.9. Model prices may change, for example after a provider revises its rates or a new model version appears. A change never affects Generations that have already started. You always see the price in force before you start a Generation.

5.10. If a payment is reversed or charged back, we may take the matching amount off your Balance. If this leaves the Balance below zero, we may suspend the Account until the shortfall is paid.

6. Refunds and right of withdrawal

6.1. Our own refund rule. You can ask for a refund of a Top-up within 14 days of making it, by e-mail to promptowy@gmail.com sent from the address tied to your Account. An untouched Top-up is refunded in full; a partly used one is refunded for the unused part. Referral credits are never refunded. The money goes back to the payment method you used, within 14 days of our receiving your request.

6.2. Consumers in the EU and the UK. As a Consumer in the EU or the UK you have a legal right to withdraw from a distance contract within 14 days without stating a reason. At checkout you request that we begin performing the Service straight away and you confirm that the right of withdrawal is lost for Generations already fully performed. So if you withdraw, you pay for the Generations made before withdrawal and we return the remainder of what you paid for that Top-up. Section 6.1 gives you at least the same outcome, and you may rely on whichever you prefer.

6.3. Top-ups cannot be refunded except under sections 6.1, 6.2 and 14.4 and where the law requires a refund.

7. API Keys and rate limits

7.1. API Keys are created and revoked in your Account. Treat them as secrets: keep them on a server, in environment variables or in a secrets manager, and never put them in client-side code, mobile apps or public repositories.

7.2. Until you revoke an API Key, you answer for all use of it and all charges it generates. If you think a key may have leaked, revoke it at once and let us know. We may revoke a key ourselves if we find it published or used in a way that points to compromise.

7.3. Unless set otherwise, one API Key can start at most 60 Generations a minute. Requests beyond a limit get HTTP 429. We may introduce further limits to protect the Service and may raise limits if you ask.

7.4. If you receive webhooks, check the x-kadraris-signature header before you trust the data. Securing your webhook endpoint is your responsibility.

8. Acceptable use

8.1. Use the Service only within the law and these Terms. It is forbidden to use the Service to create, upload, store or spread:

  • any material that sexualizes minors or shows child sexual abuse, in any form, including fictional or drawn material; we report such material to the competent authorities;
  • intimate, nude or sexual images of a real person who can be identified, without that person's consent;
  • realistic depictions of real, identifiable people (deepfakes) made without their consent, or material that falsely shows a real person saying or doing something;
  • material that impersonates a person, company, brand or public body, or that is built to deceive others about where it comes from;
  • any other unlawful material, including material that infringes intellectual property, privacy or personal rights, defames anyone, incites violence or terrorism, or harasses or threatens people;
  • malware, exploits or tools intended for unauthorized access to systems or data;
  • spam, phishing, fraud or other deceptive material, fake reviews and mass unsolicited messages included.

8.2. You are also forbidden to:

  • attempt to get around safety filters, content moderation or rate limits, for example by splitting or disguising prompts;
  • resell raw access to the Service or share API Keys so that third parties can use the Service without an Account, unless we have agreed to this in writing;
  • disrupt the Service, test it for vulnerabilities without our permission or overload it;
  • use Output against the terms of the model that created it;
  • use the Service to take decisions with legal or similarly significant effects on people without the human review the law requires.

8.3. Where the law requires it, the EU AI Act included, mark realistic images, video or audio that you publish as generated or manipulated by AI.

8.4. Model developers may enforce their own usage policies, so a model may refuse a request that does comply with these Terms. Such a refusal counts as a failed Generation and is free of charge.

9. Your Input and Output

9.1. Whatever rights you hold in your Input remain yours. You confirm that you hold the rights and consents required to submit it, including the consent of anyone whose likeness, voice or personal data appears in it.

9.2. You authorize us, on a non-exclusive and free-of-charge basis valid worldwide, to keep, handle, send and save your Input and Output, but only to the degree needed to provide the Service to you, keep your task history, prevent abuse and meet legal duties. Your Input and Output are not used to train AI models.

9.3. We do not assert any rights to your Output, insofar as the law and the conditions of the given model permit. Your freedom to use Output, commercially or otherwise, is governed by the terms of the model that produced it and on the law of the place where you use it. Many legal systems may not give copyright protection to content produced entirely by AI. We do not guarantee that Output is free of third-party rights or that it can be protected.

9.4. Responsibility for your Input, for your use of Output and for whatever you publish or distribute with the Service rests with you alone.

9.5. Output file links work for a limited time only. Your task history (prompts, parameters, model and cost) is stored for 90 days. The Service is not a storage service, so download any Output you want to keep. See the Privacy Policy for details.

10. Moderation and reporting illegal content

10.1. To spot content and activity that breach the law or these Terms, we use automated filters and, where necessary, human review. We may block single requests, remove Output, revoke API Keys and suspend or close Accounts. When we restrict your Account or content, we give you the reason and explain how to challenge the decision, unless the law forbids it or the case involves child sexual abuse or another serious crime.

10.2. Anyone may report content they consider illegal at promptowy@gmail.com. Please state why, where the content is (a task ID or a link, for example) and how to reach you. We deal with reports without delay and tell the reporter what we decided.

10.3. You may challenge a moderation decision within 6 months by replying to our notice or by writing to promptowy@gmail.com. Your appeal will be examined by a human, not by an automated system.

11. Referral program

11.1. Your Account gives you a referral link (with the ?ref= parameter). If a new user clicks it and signs up within 30 days, you earn a commission for 12 months from that sign-up: 20% of what they spend on image, video and audio models and 5% of what they spend on chat models. Only spending after the referred user's first paid Top-up (an online payment or a booked bank transfer) counts. Credit we add ourselves, such as bonuses, earns no commission.

11.2. Commissions are added to your Balance. They have no cash value and cannot be paid out, refunded or transferred.

11.3. The following are not allowed: referring yourself, referring your own or duplicate Accounts (including Accounts using a variant of the same e-mail address or created from the IP address you use), signing people up without their knowledge and promoting the Service in a misleading way. Commission earned against these rules may be withheld or reversed, and the Accounts involved may be closed.

11.4. We may modify or end the referral program by giving 30 days' notice. Commissions already credited remain on your Balance.

12. Third-party models and services

The AI models offered in the Service are built by third parties and run on third-party infrastructure. We do not answer for what third-party model licenses or policies say, but towards you we are responsible for providing the Service in line with these Terms.

13. Changes to the Service and these Terms

13.1. Amendments to the Terms are possible when there is a valid reason, such as new legislation, added features, a change of model or provider, or security considerations. You will be told about material changes by e-mail and in the Service at least 14 days before they apply, unless the law or a security threat calls for a shorter period.

13.2. If you reject the changes, you may close your Account before they apply. In that case, on request, we refund the unused part of your paid Balance (referral credits excluded).

14. Suspension and termination

14.1. You may stop using the Service and have your Account deleted whenever you wish: yourself in the dashboard (Overview, "Delete account"), which deletes it immediately, or by sending a deletion request to promptowy@gmail.com from the address tied to your Account, in which case deletion takes place within 30 days of our receiving the request. Spend your Balance or ask for a refund under section 6 before that. Save where these Terms say otherwise, money left on a deleted Account cannot be recovered.

14.2. Your Account may be suspended or closed by us, with prior notice and reasons, in case of serious or repeated breaches of these Terms, where a legal duty demands it, or where the Account is used for fraud or creates a security risk. For less serious breaches we will first ask you to stop.

14.3. If your Account is closed for breaching section 8, we may retain the unused Balance as far as needed to cover our losses and claims caused by the breach, within the limits of the law. Whatever paid Balance is left after that is refunded on request.

14.4. If we close your Account or discontinue the Service for reasons that are not your fault, we refund the unused part of your paid Balance (referral credits excluded).

15. Disclaimers

You receive the Service and Output in the state in which they are ("as is") and when they are available ("as available"). As far as the law allows, we give no warranty as to the accuracy or quality of Output or its fitness for any particular purpose. Nothing here restricts statutory Consumer rights that a contract cannot exclude, such as the right to a Service that conforms to the contract.

16. Limitation of liability

16.1. No part of the Terms restricts or excludes liability for negligently caused death or bodily harm, for intentional harm or gross negligence, for fraud, or for any other liability that applicable law does not allow to be limited.

16.2. Where you act as a business, and within what the law permits: (a) we bear no liability for indirect or consequential damage, or for lost profit, revenue, data or goodwill; and (b) our total liability under these Terms in any 12-month period cannot exceed what you paid us in that period.

16.3. Towards Consumers, we answer for damage that was foreseeable and results from our breach of these Terms, in accordance with the mandatory law that applies to you.

17. Indemnity

Business users will indemnify us against third-party claims, fines and reasonable costs that arise from their Input, their use of Output or their breach of these Terms.

18. Governing law and disputes

18.1. Polish law governs these Terms. Consumers additionally keep the protection of the mandatory rules of their country of residence.

18.2. Disputes with business users go to the court competent for our registered address. Consumers may sue in the courts of their country of residence.

18.3. Complaints can be sent to promptowy@gmail.com, and we answer within 14 days. EU Consumers may also turn to their national consumer protection authority or to an out-of-court dispute resolution body.

19. Other terms

19.1. Should any provision of these Terms be held invalid, the other provisions stay in force.

19.2. The whole agreement between you and us concerning the Service consists of these Terms, our Privacy Policy and the prices displayed in the Service.

19.3. If our business is restructured or sold, another company may take over our rights and obligations under these Terms, provided this does not diminish your rights. We will tell you about it beforehand.

19.4. These Terms enter into force on the effective date stated at the top of this page.
